3Eligibility and Account Registration
To register as a trainer, you must:
- Be at least 18 years old, or meet any higher minimum age required by applicable law.
- Have the legal capacity and authority to enter into a binding agreement.
- Provide accurate, current, and complete registration and account information.
- Use the Platform for legitimate fitness-related business or professional purposes.
- Comply with all applicable laws, regulations, and professional requirements.
- Maintain the accuracy of your account information and update it when necessary.
If you register on behalf of a business, you represent that you have authority to bind that business to these Trainer Terms.
You are responsible for maintaining the confidentiality of your login credentials and for activities carried out through your account, except to the extent that applicable law provides otherwise.
You must notify us promptly if you suspect unauthorised access to your account.
We may restrict registration, request additional information, or suspend an account where reasonably necessary to protect the Platform, comply with legal obligations, or address suspected fraud or misuse.
4Trainer Qualifications and Verification
4.1 No Routine Verification by For Fitness
For Fitness does not routinely verify or independently authenticate trainers' qualifications, certifications, professional registrations, training experience, identity, or competence before allowing them to use the Platform.
Trainers are responsible for ensuring that they possess all qualifications, certifications, registrations, licences, and other credentials required by applicable law for the fitness services they provide.
By registering for and using the Platform, you represent and warrant that:
- All qualifications, certifications, experience, and professional credentials you claim to hold are genuine, accurate, current, and not misleading.
- You are legally permitted and professionally competent to provide the services you offer.
- You will maintain any qualifications, certifications, registrations, or licences required for your activities.
- You will not represent yourself as medically qualified, professionally accredited, or endorsed by For Fitness unless that representation is accurate and expressly authorised.
4.2 False or Misleading Qualifications
- If we discover, or reasonably believe, that you have provided false, fabricated, expired where renewal is required, misleading, or materially inaccurate information about your qualifications or professional credentials, we may immediately suspend or terminate your account.
- Where appropriate, we may also remove your content, restrict your access to the Platform, or take other reasonable action to protect users and comply with applicable law.
- You acknowledge that providing false or misleading professional credentials may expose you to legal claims, regulatory action, financial liability, and other consequences.
- For Fitness does not guarantee that a trainer's qualifications or representations have been verified merely because the trainer has an active account.
5Platform Services
For Fitness provides technology that enables trainers to manage and deliver their fitness-related services.
Depending on the features available to your account, the Platform may allow you to:
- Create, customise, and manage fitness programs and workout plans.
- Add and manage clients.
- Assign programs and exercises to clients.
- Monitor client workout activity and progress.
- Communicate with clients through available features.
- Make programs or coaching services available to clients.
- Manage client-related information and coaching activities.
- Access reporting, tracking, and other available tools.
We may introduce, modify, improve, suspend, or discontinue particular features from time to time, subject to applicable law and any contractual commitments that apply to your account.
Unless expressly agreed otherwise in writing, For Fitness provides the technology platform only and does not itself provide your personal training, coaching, or fitness services to your clients.
6Platform Fees and Trainer Client Limits
6.1 How Platform Fees Work
- Trainers pay For Fitness for access to the Platform based on the number of clients they host, in accordance with the applicable pricing plan or fee arrangement presented to them.
- The applicable client limits, pricing, billing periods, and other material payment terms will be communicated through the Platform or another agreed channel.
- You are responsible for selecting and maintaining an arrangement appropriate for your intended use of the Platform.
6.2 No Commission on Trainer Earnings
- For Fitness does not charge trainers a commission on the revenue they earn from selling fitness programs, providing personal training, or offering other coaching services through their own business.
- Your earnings from client transactions are separate from the Platform Fees payable to For Fitness.
- You remain responsible for your own business expenses, taxes, refunds, chargebacks, and other financial obligations arising from your services, subject to applicable law and any applicable payment provider arrangements.
6.3 Payment of Platform Fees
- Platform Fees must be paid using the payment method and billing arrangement made available by For Fitness.
- Where applicable, Stripe may process payments for Platform Fees.
- You authorise the applicable payment provider to process payments in accordance with the payment instructions and terms presented to you.
- Failure to pay amounts due may result in restricted access, suspension, or termination of your account.
- We may change our pricing or fee arrangements by providing reasonable advance notice where required by applicable law or your contractual arrangement.
- Any change will not retrospectively alter fees already properly incurred.
7Client Payments and Trainer Earnings
7.1 Direct Relationship with Clients
- Trainers are responsible for establishing and managing their own commercial relationships with clients.
- You may collect payment directly from clients using any lawful payment method you consider appropriate, subject to any applicable legal requirements and the terms of the payment provider you use.
- For Fitness does not charge a commission on such payments and does not necessarily collect, process, or hold payments made directly between trainers and clients.
- Unless expressly agreed otherwise, the contract for your training services is between you and your client, not between your client and For Fitness.
- You are responsible for communicating your prices, payment arrangements, cancellation conditions, refund terms, and other material service conditions to clients before they purchase your services.
7.2 Payments Processed Through Stripe
- Where your client payments are processed through a Stripe integration provided for your use, the applicable Stripe account and payment arrangements will govern the processing and settlement of those payments.
- You must provide accurate payment and banking information and complete any onboarding, identity checks, business verification, or other requirements imposed by Stripe.
- Stripe may require information or documentation before enabling payments or payouts. Such requirements are separate from For Fitness's own trainer qualification verification practices.
7.3 Payouts to Your Bank Account
Where Stripe processes your client payments and facilitates payouts, your eligible funds will be transferred to your designated bank account on a rolling payout schedule, subject to Stripe's applicable processing arrangements.
Your payouts are subject to applicable Stripe processing fees, which will be deducted from the relevant funds or otherwise charged in accordance with the applicable Stripe terms. For Fitness does not charge a commission on your client earnings.
The amount and timing of each payout may depend on factors including:
- The payment methods used by your clients.
- Payment processing and settlement times.
- Your Stripe account configuration and payout schedule.
- Applicable Stripe fees and other authorised deductions.
- Bank processing times, weekends, and public holidays.
- Verification requirements, account reviews, reserves, disputes, refunds, chargebacks, or other payment-related restrictions.
We do not guarantee that every payment will be available for immediate withdrawal or that funds will arrive in your bank account at a particular time.
You are responsible for maintaining accurate bank account details and complying with Stripe's applicable terms and requirements.
7.4 Refunds, Chargebacks, and Payment Disputes
- You are generally responsible for refunds, cancellations, and service-related disputes arising from the training programs or coaching services you provide directly to clients, subject to applicable consumer protection laws and payment provider rules.
- Where payments are processed through Stripe, the allocation of refund costs, chargebacks, processing fees, negative balances, and other payment liabilities will depend on the applicable Stripe agreement and payment configuration.
- Stripe or the relevant financial institution may investigate disputed transactions, request supporting evidence, delay payouts, or apply other measures under its applicable terms.
- You agree to cooperate reasonably with legitimate payment investigations and to provide accurate supporting information when requested.
- For Fitness is not automatically responsible for refunding your clients or resolving disputes concerning the quality, delivery, or suitability of your services. However, nothing in these Trainer Terms removes any legal responsibility that For Fitness may have under applicable law or an express agreement.
8Trainer Responsibilities and Professional Conduct
You are solely responsible for the fitness services you provide through the Platform.
You agree to:
- Provide your services honestly, professionally, and with reasonable care and skill.
- Ensure that your workout plans, fitness programs, and instructions are appropriate for the services you offer and your professional competence.
- Avoid misleading claims about your experience, qualifications, or the results clients can expect.
- Communicate clearly about the nature, scope, price, duration, and limitations of your services.
- Respect client privacy, consent, personal boundaries, and individual circumstances.
- Comply with applicable health, safety, consumer protection, advertising, and professional requirements.
- Avoid conduct that could reasonably expose clients to unnecessary or foreseeable harm.
- Handle complaints and reasonable client enquiries professionally.
- Keep appropriate records of your business transactions and professional activities where required by law.
- Comply with our Community Guidelines and any other applicable platform policies.
You must not use the Platform to facilitate fraud, harassment, discrimination, exploitation, unlawful activities, or other prohibited conduct.
We may take action against accounts that violate these obligations.
9Health, Safety, and Fitness Advice
You acknowledge that exercise and physical activity can involve risks, including injury or aggravation of existing medical conditions.
You are responsible for determining whether the services you provide are within your competence and for communicating relevant limitations and precautions to your clients.
You must not:
- Provide medical diagnoses or regulated healthcare services unless appropriately qualified and legally authorised.
- Prescribe medication or recommend the misuse of medication or performance-enhancing substances.
- Guarantee specific weight-loss, muscle-building, rehabilitation, or other health outcomes.
- Encourage clients to disregard medical advice or continue exercising despite symptoms that may require medical attention.
- Present unsubstantiated medical or health claims as established facts.
Where appropriate, you should recommend that clients seek advice from a qualified healthcare professional before undertaking activities that may be unsuitable for their circumstances.
You are responsible for the professional judgement you exercise when creating and delivering your programs.
For Fitness provides technology and does not independently assess every program for medical suitability or guarantee that a program is appropriate for a particular client.
Nothing in these Trainer Terms excludes or limits liability that cannot lawfully be excluded or limited.
10Trainer Content and Intellectual Property
10.1 Ownership of Trainer Content
Subject to third-party rights and applicable law, you retain ownership of the intellectual property rights in Trainer Content that you create and own.
You are responsible for ensuring that you have the necessary rights, permissions, and licences to upload, publish, distribute, or otherwise use your Trainer Content through the Platform.
10.2 Licence to For Fitness
By uploading or making Trainer Content available through the Platform, you grant For Fitness a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, transmit, and technically process that content to the extent reasonably necessary to:
- Operate and maintain the Platform.
- Deliver your programs and services to your clients.
- Make content available through the relevant trainer and client applications.
- Back up, secure, troubleshoot, and improve the operation of our services.
- Enforce our agreements and comply with legal obligations.
This licence continues for as long as reasonably necessary for the stated purposes, including where content must be retained temporarily for backups, legal compliance, dispute resolution, or security purposes.
We will not acquire ownership of your Trainer Content merely because you upload it.
10.3 Restrictions
You must not upload or distribute content that infringes another person's intellectual property rights, violates applicable law, or breaches our policies.
You must not copy, extract, resell, redistribute, or commercially exploit For Fitness's software, branding, or proprietary materials without our permission or another valid legal basis.
We may remove or restrict access to content where reasonably necessary to address an infringement complaint, comply with legal obligations, or enforce these Trainer Terms.
11Client Data and Privacy
11.1 Access to Client Data
The Platform may allow you to access and manage personal information relating to your clients, including contact details, workout records, fitness progress, and health-related information.
You may use Client Data only for legitimate purposes connected with providing your services, managing client relationships, and fulfilling your legal obligations.
You must not use Client Data for unrelated marketing, sell it to third parties, or disclose it to unauthorised persons.
11.2 Data Protection Responsibilities
You must comply with applicable data protection laws, including the UK GDPR and the Data Protection Act 2018, as applicable.
Depending on how you determine the purposes and means of processing Client Data, you may act as an independent data controller for information relating to your own coaching business.
You are responsible for determining your legal obligations in relation to the personal information you collect and use.
Where applicable, you must:
- Provide clients with appropriate privacy information.
- Identify and rely on a valid lawful basis for processing personal information.
- Obtain any consent required by law.
- Process health and other special category data only where a valid legal condition applies.
- Keep Client Data secure and restrict access to authorised persons.
- Respond appropriately to data subject requests.
- Notify the relevant parties or authorities of personal data breaches where legally required.
- Delete or return personal information when required by law or when it is no longer necessary, subject to applicable retention obligations.
You must not assume that a client's decision to use For Fitness automatically constitutes consent to every form of data processing by you.
11.3 Security and Confidentiality
You must take reasonable technical and organisational measures to protect Client Data against unauthorised access, loss, disclosure, alteration, or destruction.
You must promptly notify us if you become aware of a security incident involving the Platform or Client Data that may require our attention.
For Fitness processes personal information in accordance with its Privacy Policy and applicable law. These Trainer Terms do not replace that policy or any separate data processing agreement that may be required.
12Client Access and Trainer Account Status
Clients may access trainer programs and related features through the associated client application.
Where client access depends on a trainer maintaining an active account and sufficient platform capacity, the client's access may be restricted if the trainer's account expires, is suspended, or is terminated.
You acknowledge that:
- Your ability to deliver programs through the Platform depends on the availability of the relevant services and your account status.
- Clients associated with your account may lose access to platform-dependent programs and features if your access ends.
- You are responsible for communicating material access limitations to your clients and managing your contractual obligations to them.
- You should maintain appropriate copies of business records and content where legally permissible and necessary for your operations.
For Fitness does not guarantee uninterrupted client access where your account is inactive, suspended, or terminated.
However, any restriction on access remains subject to applicable law, including any mandatory consumer rights or obligations relating to previously purchased services and content.
You must not promise clients continued access to platform-dependent services beyond the period or conditions that the Platform supports.
13Refunds and Cancellations
13.1 Refunds to Clients
You are generally responsible for establishing and communicating your refund and cancellation policies for the fitness programs and services you sell directly to clients.
Your policies must comply with applicable consumer protection laws and any relevant payment provider requirements.
You must not use a refund policy to remove or restrict statutory rights that clients cannot legally waive.
Where a refund is legally required, you must comply with the applicable requirements even if your own policy states otherwise.
13.2 Refunds of Platform Fees
Requests for refunds of fees paid by trainers directly to For Fitness must be submitted to us at james.chivesa@forfitnesscoaching.com.
Any refund will be assessed in accordance with the applicable payment terms, the circumstances of the request, and applicable law.
Nothing in these Trainer Terms excludes any statutory refund or cancellation right that may apply to a trainer.
13.3 Cancellation of Services
You are responsible for communicating the cancellation terms applicable to your own coaching services and for honouring those terms.
Ending your For Fitness account does not automatically cancel separate contracts between you and your clients, nor does it automatically resolve outstanding payment obligations, refunds, or disputes.
You must make appropriate arrangements to address your outstanding obligations to clients when your account ends.
14Taxes and Business Compliance
You are responsible for determining and fulfilling your own tax, accounting, reporting, and business registration obligations arising from your activities.
This may include income tax, corporation tax, VAT, or other applicable taxes and reporting requirements, depending on your circumstances and jurisdiction.
You are also responsible for obtaining any insurance, licences, registrations, permits, or professional authorisations required for your business.
For Fitness does not provide tax, accounting, legal, or professional licensing advice through the Platform.
You should seek independent professional advice where necessary.
15Independent Relationship
- You use For Fitness as an independent trainer or business.
- Nothing in these Trainer Terms creates a partnership, joint venture, employment relationship, agency, franchise, or other representative relationship between you and For Fitness.
- You are not authorised to act on our behalf, make commitments for us, or represent that we endorse or guarantee your services.
- You are responsible for your own business activities, clients, employees, contractors, expenses, and legal obligations.
- For Fitness does not control your professional decisions merely because you use the Platform to manage your services.
16Suspension and Termination
16.1 Termination by You
You may stop using the Platform and request account closure through the available account settings or by contacting us.
You remain responsible for any outstanding fees, legal obligations, and contractual commitments to clients arising before termination.
16.2 Suspension or Termination by For Fitness
We may suspend, restrict, or terminate your account where reasonably necessary, including where:
- You breach these Trainer Terms or our other applicable policies.
- You provide false or misleading qualifications, certifications, identity information, or business details.
- You engage in fraud, harassment, abuse, or other prohibited conduct.
- You fail to pay applicable Platform Fees.
- Your activities create a material risk to clients, other users, or the Platform.
- You misuse Client Data or violate applicable privacy laws.
- We are required to act by law, a competent authority, or a payment provider's applicable requirements.
- Your conduct creates a material security, legal, or operational risk.
- We discontinue the relevant services, subject to applicable contractual and legal obligations.
Where appropriate and legally permissible, we may provide notice or an opportunity to remedy a breach before taking action.
We may take immediate action where reasonably necessary to address serious misconduct, protect users, prevent harm, or comply with legal obligations.
16.3 Consequences of Termination
When your account is suspended or terminated:
- Your access to some or all trainer features may be restricted.
- Your clients may lose access to platform-dependent programs and services associated with your account.
- Outstanding Platform Fees and other amounts properly due may remain payable.
- Your rights to use the Platform and its proprietary features will end to the extent applicable.
- We may retain information where necessary to comply with law, resolve disputes, enforce agreements, maintain security, or meet legitimate record-keeping requirements.
We will handle personal information in accordance with our Privacy Policy and applicable data protection laws.
Termination does not automatically extinguish your obligations to clients or their legal rights.
17Disclaimers and Availability
The Platform is provided to enable trainers to manage and deliver their own services.
To the extent permitted by applicable law, we do not guarantee that:
- The Platform will always be available, uninterrupted, or error-free.
- Every feature will remain available indefinitely.
- Client information or content will always be accessible without interruption.
- Every trainer will obtain clients, generate revenue, or achieve a particular business result.
- Your clients will achieve specific fitness or health outcomes.
We may carry out maintenance, updates, security measures, and technical changes that temporarily affect availability.
We will take reasonable steps to maintain the Platform and address material technical issues, but we cannot guarantee that every interruption or issue can be prevented.
Nothing in this section excludes or limits any express contractual commitment or legal responsibility that cannot lawfully be excluded or limited.
18Limitation of Liability
To the extent permitted by applicable law, For Fitness will not be liable for indirect or consequential losses, loss of profits, loss of business opportunities, or loss of anticipated savings arising from your use of the Platform.
To the extent permitted by applicable law, we are not responsible for losses arising from:
- Your own coaching services, fitness programs, or professional advice.
- Your failure to obtain required qualifications or comply with applicable law.
- Your dealings, contracts, or disputes with clients.
- Actions or omissions of third-party payment providers, banks, or other independent service providers.
- Interruptions, delays, or failures caused by events beyond our reasonable control.
- Your failure to maintain appropriate records, protect account credentials, or safeguard Client Data.
Nothing in these Trainer Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.
Where applicable law permits limitations on liability, those limitations will apply only to the extent legally enforceable.
19Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Chivesa Holdings LTD, doing business as For Fitness, from reasonable losses, liabilities, damages, and costs arising from third-party claims to the extent caused by:
- Your breach of these Trainer Terms or applicable law.
- Your fitness programs, coaching services, or professional conduct.
- Your false or misleading qualifications or representations.
- Your infringement of third-party intellectual property or privacy rights.
- Your unlawful collection, use, or disclosure of Client Data.
- Your fraud, wilful misconduct, or negligent acts or omissions.
This provision does not apply to the extent a claim or loss is caused by For Fitness's own breach, negligence, wilful misconduct, or other conduct for which it is legally responsible.
We will act reasonably in handling claims for which you may be responsible, including providing relevant information and allowing you a reasonable opportunity to participate in the defence where appropriate.
Nothing in this section creates an obligation to indemnify us for liabilities that cannot lawfully be transferred to you.
20Changes to These Trainer Terms
- We may update these Trainer Terms to reflect changes in our services, business practices, payment arrangements, security requirements, or applicable law.
- Where a change is material, we will provide reasonable notice where required by applicable law or the relevant contractual arrangement.
- The updated terms will be made available through the Platform or another appropriate communication channel.
- Where legally required, we will obtain your consent before applying material changes.
- Your continued use of the Platform after updated terms take effect will be subject to the revised terms to the extent permitted by applicable law.
- If you do not agree to a material change, you may stop using the Platform and terminate your account, subject to outstanding payment obligations and any applicable contractual requirements.
21Governing Law and Jurisdiction
These Trainer Terms and any non-contractual obligations arising out of or in connection with them are governed by the laws of England and Wales.
Subject to any mandatory legal provisions or jurisdictional protections that apply, the courts of England and Wales will have jurisdiction over disputes arising out of or in connection with these Trainer Terms.
Nothing in this section prevents either party from exercising any right that cannot lawfully be excluded under applicable law.
22General Provisions
22.1 Entire Agreement
These Trainer Terms, together with the applicable Terms of Service, Privacy Policy, Community Guidelines, and any other terms expressly incorporated by reference, govern your use of the trainer services.
Where a separate written agreement applies to a particular service or payment arrangement, its terms will apply to the extent expressly agreed and legally enforceable.
22.2 Severability
If any provision of these Trainer Terms is held to be unlawful, invalid, or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
22.3 No Waiver
Failure or delay by either party in exercising a right under these Trainer Terms does not constitute a waiver of that right.
22.4 Assignment
You may not transfer or assign your rights or obligations under these Trainer Terms without our prior written consent, except where otherwise permitted by applicable law.
We may transfer our rights or obligations as part of a business restructuring, merger, acquisition, or transfer of the relevant services, subject to applicable law and any required notices or consents.
22.5 Third-Party Services
The Platform may integrate with third-party services, including Stripe and other technology providers.
Your use of those services may be subject to separate terms and privacy policies. For Fitness is not responsible for independent third-party services except to the extent required by applicable law or expressly agreed otherwise.
22.6 Electronic Communications
You agree that we may communicate with you electronically regarding your account, Platform Fees, service updates, security matters, and changes to these Trainer Terms.
You are responsible for maintaining accurate contact details and reviewing important communications.
