1Introduction

These Client Terms and Conditions ("Client Terms") govern your access to and use of the For Fitness client mobile application and related services operated by Chivesa Holdings LTD, doing business as For Fitness ("For Fitness", "we", "us", or "our").

Our business address is:

Chivesa Holdings LTD (dba For Fitness)

Email: james.chivesa@forfitnesscoaching.com

For Fitness provides a digital platform through which clients can access fitness programs, receive workout plans from personal trainers, track workout activity and progress, and interact with other clients where these features are available.

Our platform enables independent personal trainers to manage their clients and deliver their own fitness-related services through our technology.

By registering for, accessing, or using the client application, you agree to these Client Terms, our Privacy Policy, and our Community Guidelines.

If you do not agree to these Client Terms, you must not use the client application.

2Definitions

For the purposes of these Client Terms:

  • "Platform" means the For Fitness client mobile application and the associated technology, tools, and services through which clients access trainer programs and related features.
  • "Client" or "you" means any individual who accesses or uses the Platform to receive fitness programs, track workouts, interact with other users, or access related services.
  • "Trainer" means an independent personal trainer who uses For Fitness's trainer web or mobile application to manage clients and provide fitness-related services.
  • "Trainer Content" means workout plans, exercise instructions, fitness programs, videos, images, and other material created, uploaded, or provided by a trainer.
  • "Client Data" means information relating to you, including your account information, workout records, progress information, and health or fitness data.
  • "Third-Party Services" means services provided by parties other than For Fitness, including trainers, payment providers, and health tracking services.

3Eligibility and Account Registration

You must meet the minimum age requirements specified by For Fitness and applicable law to create and use an account.

Where the Platform is available only to individuals aged 13 or older, you must be at least 13 years old to register.

When creating an account, you agree to:

  1. Provide accurate, current, and complete information.
  2. Keep your account information updated.
  3. Maintain the confidentiality of your login credentials.
  4. Take reasonable steps to prevent unauthorised access to your account.
  5. Notify us promptly if you suspect that your account has been compromised.
  6. Use the Platform for lawful purposes and in accordance with these Client Terms.

You must not impersonate another person, create an account using false information, or use another person's account without authorisation.

We may restrict or suspend accounts where reasonably necessary to protect users, maintain platform security, enforce these Client Terms, or comply with applicable law.

4Our Services

The Platform allows clients to access fitness-related features provided through For Fitness and participating trainers.

Depending on the features available, you may be able to:

  • Receive and follow workout plans assigned by your trainer.
  • Access fitness programs and exercise instructions.
  • Record and track your workouts.
  • Monitor your exercise history and fitness progress.
  • Interact with other clients through available community features.
  • Access other tools and features made available through the Platform.

The availability of particular features may depend on your trainer's account status, the programs assigned to you, and the technical capabilities of the Platform.

For Fitness may introduce, modify, or discontinue features from time to time, subject to applicable law and any contractual commitments that apply.

5Role of For Fitness and Independent Trainers

For Fitness provides the technology through which independent trainers can manage clients and deliver fitness programs.

Unless expressly stated otherwise, For Fitness is not your personal trainer and does not directly provide the coaching services offered by independent trainers.

Your agreement for personal training, coaching, or other services supplied by a trainer is generally between you and that trainer.

Trainers are responsible for their own:

  • Fitness programs, workout plans, and coaching services.
  • Professional qualifications and compliance with applicable requirements.
  • Pricing, payment arrangements, cancellation terms, and refund policies.
  • Communications with clients.
  • Decisions concerning the suitability of programs they recommend.
  • Performance of their contractual obligations to clients.

For Fitness does not routinely verify the qualifications, certifications, experience, or professional competence of every trainer using the Platform.

A trainer's presence on the Platform does not, by itself, mean that For Fitness has verified their credentials, endorsed their services, or guaranteed the quality or suitability of their programs.

You should consider a trainer's qualifications, experience, and suitability before relying on their services.

6Trainer Programs and Services

  • Trainers may make fitness programs, workout plans, and other services available to you through the Platform.
  • The content, duration, difficulty, price, and availability of these programs may vary between trainers.
  • Before purchasing or committing to a trainer's services, you should review the relevant description, price, payment arrangements, cancellation conditions, and refund policy.
  • You are responsible for deciding whether a particular trainer or program is appropriate for your needs and circumstances.
  • If you have questions about a program, its suitability, or the services included, you should contact the relevant trainer before proceeding.
  • Nothing in these Client Terms removes any legal responsibility that a trainer may have for services they provide or any rights you may have under applicable law.

7Payments, Refunds, and Cancellations

7.1 Payments to Trainers

  • Trainers generally collect payments directly from their clients using the payment methods they choose.
  • These arrangements may include bank transfers, card payments, digital payment services, or other lawful payment methods.
  • Unless expressly stated otherwise, For Fitness does not collect or process payments made directly between trainers and clients and does not charge clients on behalf of trainers.
  • You are responsible for reviewing the payment terms communicated by your trainer before making a purchase.

7.2 Trainer Refund Policies

  • Trainers are generally responsible for establishing and communicating their refund and cancellation policies for the fitness programs and coaching services they provide directly.
  • If you wish to request a refund, cancel a training arrangement, or dispute a charge relating to a trainer's services, you should ordinarily contact the trainer directly.
  • However, a trainer's refund policy cannot remove or restrict any statutory consumer rights that apply to you.
  • Your legal rights may depend on the nature of the service, how the agreement was entered into, the circumstances of the purchase, and applicable law.

7.3 Disputes with Trainers

  • For Fitness is not automatically a party to the contractual relationship between you and your trainer.
  • We do not guarantee that we will resolve every dispute involving trainer fees, missed sessions, dissatisfaction with a program, or the delivery of coaching services.
  • Where appropriate, we may review reports of misconduct, investigate suspected violations of our policies, or take action against a trainer's account.
  • Such action does not necessarily resolve any contractual or financial dispute between you and the trainer.
  • You retain any rights and remedies available under applicable law.

7.4 Payments Through Third-Party Providers

  • If a transaction is processed through a third-party payment provider, the provider's applicable terms and procedures may also apply.
  • You may be required to contact the relevant payment provider regarding a transaction, subject to the provider's rules and your legal rights.

8Health, Fitness, and Medical Disclaimer

8.1 General Fitness Information

  • The Platform is intended to support fitness activities, workout tracking, and access to fitness programs.
  • Information available through the Platform is not a substitute for medical advice, diagnosis, or treatment from a qualified healthcare professional.
  • Unless expressly stated otherwise, For Fitness does not provide medical services or establish a healthcare professional relationship with you.

8.2 Individual Health Conditions

Your health, fitness level, physical abilities, and exercise requirements may differ from those of other users.

Before starting a new exercise program, you should consider your individual circumstances and seek appropriate medical advice where necessary, particularly if you:

  • Have an existing medical condition.
  • Have an injury or physical limitation.
  • Are recovering from surgery or illness.
  • Experience pain, dizziness, unusual breathlessness, chest discomfort, or other concerning symptoms during exercise.
  • Have been advised by a healthcare professional to limit or modify physical activity.

You should stop exercising and seek appropriate medical assistance if you experience symptoms that may indicate a serious health issue.

8.3 No Guaranteed Results

  • For Fitness does not guarantee that you will achieve a particular weight, body composition, strength level, fitness result, or other health outcome through your use of the Platform or participation in a trainer's program.
  • Results may vary depending on numerous factors, including your starting fitness level, health, consistency, lifestyle, and the suitability of the program.
  • Testimonials, progress photographs, and examples of other users' results should not be interpreted as guarantees of your own results.

8.4 Personal Responsibility

  • You are responsible for making informed decisions about your participation in physical activities and for communicating relevant health concerns or limitations to your trainer.
  • You should not disregard professional medical advice or continue an activity that you reasonably believe is unsafe for you.
  • Nothing in this section excludes or limits any liability or legal responsibility that cannot lawfully be excluded or limited.

9Workout Tracking and Health Data

The Platform may allow you to record workouts, monitor exercise history, review progress, and use other fitness tracking features.

Depending on the features available and the permissions you grant, the Platform may also access or receive relevant information from compatible third-party health tracking services, such as Apple Health.

You acknowledge that:

  • Workout records and tracking information may depend on data entered by you, information supplied by your trainer, or information received from compatible devices or services.
  • Tracking information may be incomplete, delayed, inaccurate, or affected by device limitations.
  • Fitness metrics are intended to support your activities and should not be treated as a medical diagnosis.
  • Access to certain features may require you to grant device permissions or authorise connections to third-party services.

You can manage relevant permissions through your device settings or the applicable third-party service.

Our collection, use, storage, and disclosure of personal information and health-related data are governed by our Privacy Policy and applicable data protection laws.

10Your Responsibilities

You agree to use the Platform responsibly and comply with all applicable laws and policies.

You must not:

  • Use the Platform for unlawful, fraudulent, or deceptive purposes.
  • Harass, threaten, abuse, or discriminate against trainers or other users.
  • Impersonate another person or misrepresent your identity.
  • Upload or share content that infringes another person's rights.
  • Access another user's account or information without authorisation.
  • Attempt to bypass security measures or interfere with the operation of the Platform.
  • Use the Platform to distribute malware, phishing links, spam, or other harmful material.
  • Manipulate workout records, challenges, or community features through fraudulent means.
  • Misuse another person's personal or health information.
  • Use the Platform to promote dangerous fitness practices or encourage harm to others.

You must comply with our Community Guidelines, which form part of the rules governing your use of the Platform.

We may investigate suspected violations and take appropriate action in accordance with these Client Terms and applicable law.

11Community Features and User Interactions

  • Where the Platform enables you to interact with other clients, share progress, participate in challenges, or communicate through community features, you must treat other users respectfully.
  • You must not engage in bullying, body shaming, harassment, hate speech, unwanted sexual conduct, or other abusive behaviour.
  • You must not share another user's private information, photographs, messages, workout records, or health information without appropriate authorisation or another valid legal basis.
  • You are responsible for the content and communications you submit through community features.
  • For Fitness may remove content, restrict community access, or suspend accounts where reasonably necessary to protect users, enforce our policies, or comply with legal obligations.
  • You should exercise care when communicating with people you do not know and avoid sharing information that you do not wish to make available to others.

12User-Generated Content

You may be able to submit or share workout records, comments, progress updates, photographs, and other content through the Platform.

You retain ownership of the intellectual property rights in content you create and own, subject to third-party rights and applicable law.

By submitting content, you grant For Fitness a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, transmit, and technically process it to the extent reasonably necessary to operate, maintain, secure, and provide the Platform and its features.

This licence does not transfer ownership of your content to For Fitness.

You are responsible for ensuring that you have the rights and permissions required to share the content you submit.

You must not upload content that:

  • Infringes another person's intellectual property rights.
  • Contains unlawful, threatening, abusive, or discriminatory material.
  • Discloses another person's confidential or personal information without authorisation.
  • Contains misleading information intended to defraud or harm others.
  • Violates these Client Terms, our Community Guidelines, or applicable law.

We may remove or restrict content where reasonably necessary to enforce our policies, protect users, or comply with legal obligations.

13Intellectual Property

The Platform, including its software, design, branding, logos, interface, and proprietary materials, is owned by or licensed to For Fitness and is protected by applicable intellectual property laws.

Subject to these Client Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Platform for its intended purposes.

You must not:

  • Copy, reproduce, distribute, or commercially exploit the Platform or its proprietary materials without authorisation.
  • Reverse engineer, decompile, or attempt to extract source code except where such activity is permitted by applicable law.
  • Remove proprietary notices or branding.
  • Use For Fitness's name, logos, or branding in a way that suggests an unauthorised endorsement or affiliation.

Fitness programs and other content supplied by trainers may be subject to separate intellectual property rights.

You must not reproduce, redistribute, resell, or commercially exploit a trainer's programs without permission or another valid legal basis.

14Privacy and Personal Information

  • We process personal information to create and manage accounts, provide fitness tracking and program access, maintain security, communicate with users, and improve our services.
  • Depending on the features you use, the information processed may include account details, workout records, fitness progress, device information, and health-related data.
  • We handle personal information in accordance with our Privacy Policy and applicable data protection laws, including the UK GDPR and the Data Protection Act 2018, where applicable.
  • You should review our Privacy Policy to understand what information we collect, how we use it, who may receive it, and what rights you may have.
  • Where you choose to share information with a trainer or another user, that information may be processed by the recipient in accordance with their own legal obligations and privacy practices.
  • You should avoid sharing sensitive personal information unless it is necessary and appropriate for the relevant purpose.

15Third-Party Services and Integrations

  • The Platform may integrate with or rely on third-party services, including health tracking services, authentication providers, hosting providers, and analytics tools.
  • Your use of those services may be subject to separate terms and privacy policies.
  • For Fitness does not control every aspect of third-party services and cannot guarantee their continuous availability, compatibility, or accuracy.
  • Where you connect a third-party service, you are responsible for reviewing its permissions and applicable terms.
  • Nothing in this section excludes any responsibility that For Fitness may have under applicable law for services it provides or representations it makes.

16Access to Programs and Account Restrictions

  • Access to programs and other features may depend on your trainer maintaining an active account and sufficient platform capacity.
  • If your trainer's account expires, is suspended, or is terminated, you may lose access to programs and other features associated with that trainer.
  • You acknowledge that For Fitness does not guarantee continued access to a trainer's platform-dependent content where the trainer no longer has the right or ability to provide that access.
  • If your access is affected, you may need to contact your trainer to discuss alternative arrangements, refunds, or continued delivery of any services you have purchased.
  • Trainers remain responsible for their contractual obligations to clients, subject to applicable law.
  • Nothing in this section removes any rights you may have concerning previously purchased services, digital content, refunds, or other remedies under applicable law.
  • We may also suspend or restrict your access if you violate these Client Terms, misuse the Platform, create a security risk, or engage in conduct that justifies such action.
  • Where appropriate and legally permissible, we may provide notice and an opportunity to appeal an enforcement decision.

17Suspension and Termination

You may stop using the Platform and request account deletion through the available account settings or by contacting us.

We may suspend, restrict, or terminate your account where reasonably necessary, including where:

  • You breach these Client Terms or our other applicable policies.
  • You engage in fraud, harassment, abuse, or other prohibited conduct.
  • You compromise the security or integrity of the Platform.
  • You misuse another person's information or intellectual property.
  • We are required to do so by law or a competent authority.
  • Your conduct creates a material risk to other users or our services.

Where appropriate, we may issue a warning or request that you remedy a breach before restricting your account.

We may take immediate action where reasonably necessary to protect users, prevent harm, address serious misconduct, or comply with legal obligations.

Termination may result in the loss of access to your account, workout history, programs, or other platform-dependent features.

We will handle personal information following termination in accordance with our Privacy Policy and applicable law, including any applicable retention or deletion requirements.

Account termination does not remove any rights or obligations that have already accrued or any statutory rights that cannot lawfully be excluded.

18Availability and Changes to the Platform

  • We aim to provide a reliable and useful service, but we do not guarantee that the Platform will always be available, uninterrupted, or error-free.
  • Access may occasionally be affected by maintenance, technical issues, updates, third-party service failures, security incidents, or circumstances beyond our reasonable control.
  • We may modify, improve, or discontinue features where reasonably necessary to maintain or develop our services, comply with legal obligations, or address security and operational requirements.
  • Where a change materially affects a service you have paid for, we will comply with any applicable contractual and legal obligations, including requirements relating to notice, refunds, or other remedies.
  • Nothing in these Client Terms removes any statutory rights you may have in relation to the quality, description, or availability of digital content or services.

19Disclaimers and Limitation of Liability

19.1 Services Provided by Independent Trainers

For Fitness provides the technology platform and does not routinely verify every trainer's qualifications or independently assess every program for individual suitability.

To the extent permitted by applicable law, For Fitness is not responsible for the independent professional advice, conduct, or services of a trainer merely because those services are accessed through the Platform.

This does not exclude any responsibility For Fitness may have for its own acts or omissions or under applicable law.

19.2 Limitation of Liability

To the extent permitted by applicable law, For Fitness will not be liable for indirect or consequential losses that are not reasonably foreseeable consequences of a breach of these Client Terms.

We are not responsible for losses arising solely from your misuse of the Platform, your failure to follow reasonable safety precautions, or the acts or omissions of independent third parties, except where applicable law provides otherwise.

Nothing in these Client Terms excludes or limits liability for:

  • Death or personal injury caused by negligence.
  • Fraud or fraudulent misrepresentation.
  • Breach of any legal obligation that cannot lawfully be excluded or limited.
  • Any other liability that cannot lawfully be excluded or limited.

Where you are a consumer, nothing in these Client Terms removes or restricts your statutory rights, including any rights relating to digital content and services under applicable consumer protection legislation.

20Changes to These Client Terms

  • We may update these Client Terms from time to time to reflect changes to our services, features, business practices, or legal obligations.
  • Where changes are material, we will provide notice where required by applicable law or our contractual commitments.
  • The updated version will be made available through our website, application, or another appropriate communication channel.
  • Where legally required, we will obtain your consent before applying changes.
  • Your continued use of the Platform after updated terms take effect will be subject to the revised terms to the extent permitted by applicable law.
  • If you do not agree to a material change, you may stop using the Platform, subject to any outstanding contractual obligations and your statutory rights.

21Governing Law and Jurisdiction

  • These Client Terms and any non-contractual obligations arising out of or in connection with them are governed by the laws of England and Wales.
  • Subject to applicable consumer protection laws and mandatory jurisdictional rules, the courts of England and Wales will have jurisdiction over disputes arising from these Client Terms.
  • If you are a consumer residing outside England and Wales, you may also benefit from mandatory consumer protections or rights to bring proceedings in your country of residence, where applicable.
  • Nothing in this section restricts any rights or remedies that cannot lawfully be excluded.

22General Provisions

22.1 Entire Agreement

These Client Terms, together with our Privacy Policy and Community Guidelines, govern your use of the client application, subject to any separate agreement that expressly applies to a particular service.

Your separate agreement with a trainer governs the coaching services that the trainer provides to you, subject to applicable law.

22.2 Severability

If any provision of these Client Terms is found to be unlawful, invalid, or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

22.3 No Waiver

Failure or delay in exercising a right under these Client Terms does not constitute a waiver of that right.

22.4 Third-Party Rights

Except where expressly stated or required by law, these Client Terms do not confer contractual rights on third parties.

22.5 Electronic Communications

We may send service-related communications electronically, including account notifications, security alerts, and information about changes to the Platform or these Client Terms.

You are responsible for maintaining accurate contact details and reviewing important service-related communications.
